- You are responsible for keeping your password secure. Love to Live Well ’s “Get Healthy Online” cannot and will not be liable for any loss or damage from your failure to maintain the security of your account and password.
- You agree that Love to Live Well will communicate with You electronically (email) as the primary method of communication regarding security, privacy, and administrative issues relating to Your use of the Services or these Terms. If Love to Live Well learns of a security system's breach, Love to Live Well may attempt to notify You electronically by posting a notice through the Services or sending an email to You. You may have a legal right to receive this notice in writing. To receive free written notice of a security breach (or to withdraw Your consent from receiving electronic notice), please write to Love to Live Well at [email protected].

2 General Conditions - The person signing up for the Service will be the contracting party (“User”) for the purposes of our Terms of Service and will be the person who is authorized to use any corresponding account we provide to the User in connection with the Service.
- Technical support is available via email or phone.
- You agree not to reproduce, duplicate, copy, sell, resell, misuse or exploit any portion of the Service (including course materials), use of the Service, or access to the Service without the express written permission by Love to Live Well.
- The trademarks, service marks, and logos (the "Trademarks") used and displayed through Our Services or in any Company Content are Our registered or unregistered Trademarks or of Our affiliates or partners and are protected pursuant to U.S. and foreign trademark laws. All rights are reserved and You may not alter or obscure the Trademarks, or link to them without Our prior approval.
- You shall not purchase search engine or other pay-per-click keywords (e.g. Google AdWords), or domain names that use Get Healthy Online or Love to Live Well or Love to Live Well trademarks and/or variations and misspellings thereof
- Love to Live Well is committed to advancing the science of learning, teaching, and health education/health promotion. Records of your participation and outcomes in courses may be used for research and program evaluation and improvement. In the interest of this health education/health promotion research, you may be exposed to variations in the course content. Research findings will be reported at the aggregate level. Your personal identity will never be publicly disclosed without your express consent.
| WHICH MEANS The person signing up for the Service is responsible for the account and is bound by these Terms of Service. The Love to Live Well’s “Get Healthy Online” Service belongs to us. You are not allowed to steal or copy it or use it for any illegal or sketchy purpose. We can do evaluation and research on the de-identified data to improve the program and present health promotion research.

3 Love to Live Well ’s “Get Healthy Online” Rights - We reserve the right to modify or terminate the Service for any reason, without notice at any time.
- We reserve the right to refuse service to anyone for any reason at any time.
- Love to Live Well retains the right to determine, in our sole judgment, rightful account ownership and transfer an account to the rightful owner. If we are unable to reasonably determine the rightful User, Love to Live Well reserves the right to temporarily disable an account until resolution has been determined between the disputing parties.
| WHICH MEANS We can modify, cancel or refuse the service at any time. In the event of account ownership dispute, we can freeze the account or transfer it to the rightful owner. |
4 Acceptable Use Policy (Obligations of Users) As a User, You represent, warrant and covenant that: - Verbal or written abuse of any kind (including threats of abuse or retribution or harassment) of any Love to Live Well ’s “Get Healthy Online” customer, Love to Live Well employee, affiliate, or partner will result in immediate account termination.
- You are over the age of 18, or, if not, You will only use the Services with the supervision and approval of a parent or legal guardian.
- You will not upload, post or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes or any other form of solicitation (commercial or otherwise) through the Services.
- You will not post or provide any inappropriate, offensive, racist, hateful, sexist, pornographic, false, misleading, incorrect, infringing, defamatory or libelous content or information.
- You will not copy, modify, reverse engineer, reproduce, distribute, publicly display, publicly perform, communicate to the public, create derivative works from, deface, tarnish, mutilate, hack, interfere with, or otherwise use and exploit any Company Content, the Services or Courses or Submitted Content except as permitted by these Terms or the relevant Instructor as applicable.
- You will not impersonate another person or entity or gain or attempt unauthorized access to another User's Account.
- You will not solicit personal information from any Instructor or other User.
- You will not do anything that violates local, state, national or international law or breaches any of your contractual obligations or fiduciary duties.
- You will not access, tamper with, or use non-public areas of our systems, unless specifically authorized to do so.
- You will not break or circumvent our authentication or security measures or otherwise test the vulnerability of our systems or networks, unless specifically authorized to do so.
| WHICH MEANS Verbal or written abuse, harassment of any individual affiliated with the Service will not be tolerated and will result in immediate account termination. You are 18 or have your parents approval and participation in using the Service. You will not pursue any dishonesty like plagiarism, posting inappropriate content, pretend to be someone else, hacking, tampering, or solicit any information from other Users. |
5 Limitation of Liability/Indemnification - You hereby indemnify, defend and hold harmless Love to Live Well, and its affiliates, agents, partners, employees, or representatives from and against all reasonably foreseeable losses, expenses, injuries, damages, costs, claims and demands.
- You expressly understand and agree that Love to Live Well shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages resulting from the use of or inability to use the service.
- Your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis without any warranty or condition, express, implied or statutory.
- We do not warrant or guarantee results that may be obtained from the use of the Service as your success depends on how well you implement the changes we provide you and how consistent you are in making the choice to be healthier every day. If you feel that you need a more tailored plan to reach success, please look into one of our wellness or weight loss packages for individuals. These provide a detailed meal plan tailored to your needs and individualized health coaching/nutrition counseling (medical nutrition therapy) to increase accountability and tailor the program to your needs.
| WHICH MEANS We are not responsible for any loss, expense, or injury. Service is “as is” so it may have errors or interruptions and we provide no warranties or guarantees about results as your health behaviors are your responsibility.

6 Waiver and Complete Agreement - The failure of Love to Live Well to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Love to Live Well and govern your use of the Service, superseding any prior agreements between you and Love to Live Well (including, but not limited to, any prior versions of the Terms of Service).
| WHICH MEANS If Love to Live Well chooses not to enforce any of these provisions at any time, it does not mean that they give up that right later. |
7 Payment of Fees - A valid credit card is required for accounts able to process orders using a live payment gateway.
- Credit Card information is always encrypted during transfer over networks.
- Payment by check is available if preferred, but check must be processed prior to account activation.
- All fees are exclusive of applicable federal, provincial, state, local or other governmental sales, goods and services, harmonized or other taxes, fees or charges now in force or enacted in the future (“Taxes”).
- No refunds will be given in the first 15 days. Our goal is for you to implement real behavior change in your daily lives. You need at least 2 weeks to apply the content to know whether our program will fit your needs. After that you will have a 15-day window to request a refund if you are not satisfied with the program. Refunds may be requested by email ([email protected] or fax 940-312-7283 as requests must be in writing.
- Exchanges for other Services will be allowed in the first 7 days of purchase in the event you purchased the wrong service.
- Please note that if We believe that You are abusing Our refund policy in Our sole discretion, We reserve the right to suspend or terminate Your Account and refuse or restrict any and all current or future use of the Services, without any liability to You.
- Please also note that we treat violations of our Terms of Service very seriously, and we have no obligation to offer refunds to Users who are found to be in violation of these terms, even if their requests are made within the designated refund period. Similarly, we have no obligation to offer late refunds to Users who do not pass a course or Specialization, or who are otherwise unsatisfied with their final grade.
| WHICH MEANS For live payment gateways (that are secure), a valid credit card is required. Check is also accepted but may delay account activation. All applicable taxes will be applied if necessary but those will be in addition to the fees posted for the Service. Refunds will be given between 15 & 30 days after purchase to allow enough time to evaluate the program If we think you are abusing our refund policy, you’re account will be terminated. |
8 Modifications to the Service and Prices - Prices for using Love to Live Well are subject to change upon 30-days notice from Love to Live Well. Such notice may be provided at any time by posting the changes to the Love to Live Well Site (www.lovetolivewell.com) or the menu of Love to Live Well’s “Get Healthy Online” site via an announcement.
- Love to Live Well reserves the right at any time to time to modify or discontinue, the Service (or any part thereof) with or without notice.

9 Inherent Risk in Health and Wellness Courses
1.You acknowledge that there are certain inherent risks and dangers in the strenuous nature of some health and wellness course(s) and that you have voluntarily chosen to participate in Love to Live Well’s “Get Healthy Online” program. 2.You acknowledge that Love to Live Well and the instructors of Love to Live Well’s “Get Healthy Online” strongly recommend that you consult with your physician prior to commencing any physical activity. 3.You also acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. In consideration of being allowed to participate in and access the Love to Live Well’s “Get Healthy Online”, you hereby (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to the content, (2) release, indemnify, and hold harmless Love to Live Well, its employees, affiliates, partners, and all others, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in Love to Live Well’s “Get Healthy Online”, and (3) represent that you (a) have no medical or physical condition that would prevent you from properly using Love to Live Well’s “Get Healthy Online”, (b) do not have a physical or mental condition that would put you in any physical or medical danger, and (c) have not been instructed by a physician to not participate in physical exercise. 4.You acknowledge that if you have any chronic disabilities or conditions, you are at risk in participating in Love to Live Well’s “Get Healthy Online”, and should not consult your health care provider before participating in any physical activity or exercise of any sort. | WHICH MEANS You participate in the health behaviors suggested at your own pace, your own risk, and be sensible about your actions. Seek approval of your doctor before participating in any exercise or physical activity. |
10 Termination
Love to Live Well reserves the right to terminate, suspend, modify, or delete, at Our sole discretion, any (a) Submitted Content, Company Content, Courses, or any Service; and (b) Your access to Our Services or Your Account, as follows: - If You breach or violate any of these Terms or any of Our applicable policies, as posted on Our Services from time to time, Love to Live Well may take action immediately without prior notice to You. If We take action pursuant to this section, We shall not have any liability to You for any Course(s) You may have purchased nor for any other use of Our Services associated with Your Account. For avoidance of any doubt, You understand and agree that You will not be compensated nor be eligible for any refund under any circumstances for any such access lost to Our Services, including without limitation to Course(s) You may have purchased.
You may terminate Your use of the Services at any time, either by ceasing to access them, or by deleting Your Account. | WHICH MEANS We can terminate your account at any time.
